Ciomia Terms of Service

These Terms of Service ("Terms") are an agreement between you and the provider of the Ciomia app ("Ciomia", "we", "us"). Please read them together with our Privacy Policy.

By downloading, installing, purchasing, or using Ciomia, you agree to these Terms. If you do not agree, do not use the app. The current version is available at https://ciomia.app/terms.

1. Provider and contact details

Questions, complaints, support requests, and claims relating to the app may be sent to the contact details above.

2. Eligibility

You must be at least 13 years old, or any higher minimum age required by the law applicable to you or to the particular feature you use.

If applicable law requires consent or authorization from a parent or legal guardian, you may use Ciomia only after that requirement has been satisfied.

You must also have legal capacity to enter into these Terms. If you use Ciomia on behalf of another person or organization, you represent that you are authorized to do so.

3. What Ciomia is: medical and wellness disclaimer

Ciomia is a general-wellness and informational app. It can help you view, organize, and understand health and wellness information from Apple Health and information you enter, and may present non-diagnostic scores, summaries, trends, or explanations.

**Ciomia is not a medical device unless a specific released feature is expressly identified as such, and Ciomia does not provide medical advice.** The general-wellness features covered by these Terms are not intended to diagnose, treat, cure, mitigate, or prevent disease or to replace professional medical judgment.

Do not use Ciomia for emergencies. Do not disregard or delay professional medical advice because of information shown by the app. Consult a qualified healthcare professional before making decisions about a medical condition, diagnosis, medication, treatment, or other clinical care.

Scores, trends, biomarker context, AI-generated explanations, and similar content may be incomplete, delayed, unavailable, or inaccurate. They are informational aids, not clinical conclusions.

4. Your data and device

Ciomia does not require a separate Ciomia account or login for the version covered by these Terms. Ciomia is designed to operate within the Apple ecosystem and uses Apple-provided platform services for supported app functionality, including, where available and enabled, data availability across compatible Apple devices associated with your Apple Account.

Ciomia does not operate a separate health-data synchronization service for these ecosystem functions. Availability and synchronization may depend on your Apple Account, device configuration, network access, available storage, and Apple services.

You are responsible for maintaining reasonable security for your device and Apple Account and for exports or copies that you intentionally create. Deleting app data, changing Apple settings, signing out of an Apple Account, or deleting the app may affect data availability. Ciomia cannot guarantee recovery of information that is unavailable through the app or applicable Apple platform services.

5. License and Apple usage rules

The app is licensed, not sold.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-sublicensable, and non-transferable license to use Ciomia on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions and applicable Usage Rules.

Where Apple's Usage Rules permit Family Sharing, volume purchasing, or access by other accounts associated with the purchaser, those Apple rules apply.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, attempt to derive source code from, or circumvent technical or subscription controls in the app, except to the extent a restriction is prohibited by applicable law or permitted by applicable open-source license terms.

6. Subscriptions, trials, billing, and refunds

Ciomia offers an auto-renewing monthly subscription that unlocks premium functionality. The applicable subscription price, currency, and any applicable taxes are displayed by the App Store before purchase and may vary by country or region.

Where offered and where you are eligible, Ciomia includes a 3-day free trial. Unless cancelled before the end of the trial, the subscription automatically converts to a paid monthly subscription at the price displayed by the App Store.

Purchases and billing are processed by Apple through your App Store account. We do not receive your payment-card number.

The subscription renews automatically each month until cancelled through the mechanisms provided by Apple. You can manage or cancel the subscription through your Apple Account subscription settings. Cancellation normally takes effect at the end of the then-current subscription period, subject to Apple's applicable terms and mandatory law.

Refund eligibility and refund processing for App Store transactions are handled by Apple under Apple's rules and applicable consumer law. Where available, you may request a refund through Apple's "Report a Problem" process.

If the app provides a Restore Purchases function, it can be used to ask Apple to restore eligible entitlements.

Nothing in this Section limits refund, cancellation, withdrawal, or other consumer rights that cannot lawfully be excluded.

7. Acceptable use

You must not:

  • use Ciomia unlawfully or to infringe another person's rights;
  • interfere with, disrupt, damage, or attempt unauthorized access to the app or services it legitimately relies on;
  • bypass subscription, entitlement, security, or technical restrictions except where applicable law expressly permits;
  • use the app or its output as a substitute for emergency services or professional medical diagnosis or treatment; or
  • misuse export or sharing features to disclose another person's information without authority.

8. Intellectual property

Ciomia's software, branding, user interface, graphics, text, and other provider-created content are owned by the provider or its licensors and are protected by applicable intellectual-property laws.

You retain rights you have in information and content that you enter into the app.

If a third party claims that Ciomia or your authorized possession or use of Ciomia infringes that third party's intellectual-property rights, **the provider, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim**, to the extent required by Apple's minimum EULA terms and applicable law.

9. Apple and other platform terms

Ciomia is a "Licensed Application" for purposes of Apple's applicable App Store terms.

You and the provider acknowledge and agree that:

  • these Terms are concluded between you and the provider, not Apple;
  • the provider, not Apple, is solely responsible for Ciomia and its content;
  • the provider is solely responsible for maintenance and support services for Ciomia to the extent required by these Terms or applicable law, and Apple has no obligation to provide maintenance or support;
  • the provider is responsible for addressing claims relating to Ciomia or your possession or use of it, including product-liability claims, claims that the app fails to comply with legal or regulatory requirements, and consumer-protection, privacy, or similar claims, including claims connected with HealthKit;
  • if Ciomia fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the Licensed Application, if any; to the maximum extent permitted by law, Apple has no other warranty obligation for Ciomia, and the provider is responsible for other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty;
  • you must comply with applicable third-party terms when using Ciomia, including the terms applicable to your Apple account, device, network, and Apple services; and
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce the applicable Apple-related provisions against you.

Ciomia may use Apple-provided platform services for health access, security, storage, synchronization, backup, restoration, cross-device data availability, purchases, and other supported functionality. Your use of Apple Health, HealthKit, your Apple Account, the App Store, StoreKit, Apple Intelligence, Foundation Models, and other Apple services is also subject to the applicable Apple terms and policies.

10. Legal compliance

You represent and warrant that:

  1. you are not located in a country or region that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a country supporting terrorism; and
  2. you are not listed on any U.S. Government list of prohibited or restricted parties.

You must use Ciomia in compliance with laws applicable to you.

11. Disclaimers of warranty

To the maximum extent permitted by applicable law, Ciomia is provided "as is" and "as available." We disclaim warranties that may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that Ciomia will always be available, uninterrupted, error-free, or suitable for a particular medical or personal purpose, or that any score, trend, prediction, summary, or AI-generated text will be complete or accurate.

**Nothing in these Terms excludes, restricts, or modifies a warranty, guarantee, statutory right, or remedy that applicable mandatory law does not allow us to exclude, restrict, or modify.**

12. Limitation of liability

To the maximum extent permitted by applicable law, the provider is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, goodwill, or data, arising from or related to Ciomia.

Where applicable law permits a contractual cap, the provider's aggregate liability arising out of or relating to Ciomia will not exceed the greater of (a) the amount you paid for Ciomia during the 12 months immediately preceding the event giving rise to the claim or (b) USD 50.

These exclusions and limits do not apply where liability cannot lawfully be excluded or limited, including, where applicable, liability for fraud, fraudulent misrepresentation, intentional misconduct, or death or personal injury caused by negligence, and they do not limit mandatory consumer rights.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above provisions may not apply to you.

13. Indemnification

To the extent permitted by applicable law, if you use Ciomia in a business or other non-consumer capacity, you agree to indemnify the provider against third-party claims, losses, and reasonable costs arising from your unlawful misuse of Ciomia, your material breach of these Terms, or your infringement of another person's rights.

**This Section does not require a consumer to indemnify the provider to the extent such an obligation would be unfair, unenforceable, or prohibited by mandatory consumer law.**

14. Changes to Ciomia and these Terms

We may update or discontinue features, subject to applicable law and any obligations associated with paid functionality.

We may update these Terms to reflect changes to Ciomia, Apple platform requirements, legal requirements, security needs, or business practices. We will update the "Last updated" date and publish the current version at https://ciomia.app/terms.

For material changes, we will provide notice or obtain renewed acceptance where required by applicable law. A change will not retroactively remove rights that mandatory law gives you.

If you do not agree to revised Terms, you should stop using Ciomia and manage any active subscription through Apple.

15. Governing law and disputes

These Terms are governed by the laws of Ukraine, without regard to conflict-of-laws principles, **except that this choice does not deprive a consumer of mandatory protections that apply under the law of the consumer's habitual residence or another law that cannot contractually be displaced**.

If you are a consumer, you may bring a claim in any court or forum available to you under mandatory applicable law. Nothing in these Terms requires a consumer to waive a mandatory right to bring proceedings in a competent local court.

Before starting formal proceedings, you may contact us at ciomia.support@gmail.com so we can try to resolve the issue informally. This informal step does not prevent you from using a regulator, court, alternative dispute-resolution body, or other remedy available under applicable law.

16. General terms

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect to the extent permitted by law.

Our failure to enforce a provision is not a waiver of that provision.

We may assign these Terms as part of a lawful reorganization, transfer of the Ciomia business, or transfer of relevant intellectual-property rights, subject to applicable consumer law. You may not transfer your rights under these Terms except where applicable law or Apple's Usage Rules permit.

These Terms, together with the Privacy Policy and any purchase terms shown by Apple, form the agreement governing your use of Ciomia, subject to rights that cannot be waived by contract.
